Family Legal Separation
With a judgment of legal separation between spouses or Domestic Partners, parties can end their relationship, but remain married or domestic partners and attain court orders on parenting and money. The following court orders can be attained in this kind of scenario:
- Child custody
- Child visitation
- Child support
- Spousal support
- Community and separate property
- Community and separate debt
A judgment of legal separation is NOT the same as divorce and does NOT allow any of the parties to remarry or enter into a new domestic partnership. Some couples obtain a legal separation as an alternative to a divorce, based on moral or religious objections to divorce. However, since legal separation does not equate to or lead to divorce, if a couple is not able to reconcile and eventually decide to permanently end their marriage or domestic partnership, they will have to then explicitly file for a divorce.
